States Challenge Attempted Federal Power Grab in Hydraulic Fracturing Issue

The Interstate Oil and Gas Compact Commission (IOGCC) reaffirmed its strong stance today that the states remain the best positioned to regulate the use of hydraulic fracturing for the production of oil and natural gas.

The response comes on the heels of a bill introduced in the House and the Senate yesterday calling for the repeal of the exemption of hydraulic fracturing from the Safe Drinking Water Act (SDWA), which would ultimately give the federal government jurisdiction over the regulation of the technology.

“The states do a superb job of protecting human health and the environment through sound regulation,” said Carl Michael Smith, IOGCC executive director. “An unnecessary shift to federal regulation of hydraulic fracturing could greatly inhibit the production of much-needed oil and natural gas resources at a time when our nation’s energy security is critical.”

Hydraulic fracturing is a common half century old technology that plays a major role in the development of virtually all unconventional oil and natural gas resources. Recently some have made claims that the process can contaminate underground drinking water sources.

Historically the states have been the primary regulators of hydraulic fracturing. IOGCC member states each have comprehensive laws and regulations to provide for safe operations and to protect drinking water sources, and have trained personnel to effectively regulate oil and natural gas exploration and production.

Multiple studies have been conducted on this issue, including an extensive study by the U.S. EPA in 2004 and a survey of IOGCC member state regulators. To date there are no verified cases of contamination of underground drinking water as a result of the process.

“As the head regulator of oil and natural gas development in the state of North Dakota and an officer of the IOGCC representing all oil and natural gas producing state regulators, I can assure you that we have no higher priority than the protection of our states’ water resources,” said Lynn Helms, director of North Dakota’s Department of Mineral Resources in a House Energy and Mineral Resources Subcommittee hearing last week. “It is my firmly held view and that of the IOGCC that the subject of hydraulic fracturing is adequately regulated by the states and needs no further study.”

The IOGCC passed a resolution urging Congress to refrain from taking action on this issue in December of last year maintaining that SDWA was never intended to grant the federal government authority to regulate oil and gas drilling and production operations, such as “hydraulic fracturing,” under the Underground Injection Control program. Since that time several states have followed suit and filed their own resolutions, including Alabama, Louisiana, North Dakota, Oklahoma, Texas, Utah and Wyoming.

“Regulation of hydraulic fracturing as underground injection under the SDWA would impose significant administrative costs on the state, substantially increase the cost of drilling oil and natural gas wells with no resulting environmental benefits, and increase energy costs to the consumer,” the resolution stated.

New Orleans native will celebrate debut book release on 4th anniversary of hurricane.

On August 27th, 2005, two days ahead of Hurricane Katrina, Daphne Marie Doucette and her family fled New Orleans, Louisiana in her Toyota Sequoia en route to Alabama. Underestimating the threat of Katrina, Doucette packed very little and as a result left behind floppy discs of her three finished manuscripts, which represented nearly four years of work at her personal computer. By the next night, Doucette was in Atlanta, Georgia, finally realizing the gravity of her miscalculation as predictions regarding Katrina grew more grave with each CNN broadcast.

One day later, August 29th, even the darkest of predictions were not enough to prepare anyone for what would become reality. Hurricane Katrina made landfall on the Gulf Coast, destroying lives, leveling homes, and leaving thousands of survivors with the same story: “We lost everything.” Despite her gratitude regarding her family’s safety, Doucette could not refrain from counting what she had lost, and it was then that she remembered the manuscripts she had left behind.

For two long months, Doucette believed that her work was gone forever. The thought of recreating it was too daunting and she tried to come to grips with the fact that her dream of being a published author had become impossible in the wake of Katrina. However, in October of 2005, Doucette’s younger sister recovered the floppy discs containing her sister’s three finished manuscripts. Thankfully, Doucette had long since developed the habit of placing her most treasured possessions in the uppermost drawer of her furniture chest. Although the chest had been pushed over by the water of Lake Pontchartrain that had infiltrated the house, it had fallen forward against a bed in such a way that the contents in the top drawer were totally salvageable.

Having the discs back in her hands again, Doucette recommitted herself to seeing her work recognized and published. The fact that the discs had survived the elements refueled her passion and she immediately went to work revising Dirty Butter, the manuscript she believed was destined to be her debut book release. “Dirty Butter has been six years in the making for me. God willing, it will do well. No matter what becomes of the book, my message is to remember that there’s always a rainbow after every storm,” says Doucette.

After a few false starts, Dirty Butter is ironically set to be released on the 4th anniversary of Hurricane Katrina by Waterway Books®. Two hundred and one colleges and universities in nine Southeastern states receive annual grants from the Lettie Pate Whitehead Foundation, which received the Council of Independent Colleges 2008 Award for Philanthropy on Sunday. The primary purpose of the foundation is to provide educational opportunities to needy women in nine Southeastern states.

Based in Atlanta, GA, the Foundation annually funds scholarships for over 8,000 female students at 201 schools in Alabama, Florida, Georgia, Louisiana, Mississippi, North Carolina, South Carolina, Tennessee and Virginia. While most of the Lettie Pate Whitehead scholarship funds go toward undergraduate higher education, the foundation maintains a special interest in health education. Approximately 25 percent of its scholarship grants target the medical, nursing and allied health fields. The foundation also supports 14 nursing homes and hospice care programs.

“I would not be able to attend school at all if it weren’t for this scholarship,” said Crystal Daniels, a recent recipient. “I’m the first person in my family to attend college. Now I’ll be able to achieve my life goals and develop a successful career. The scholarship allows me to create my own future.”

“Through more than 200,000 scholarships awarded, the Whitehead family has left a lasting legacy across the region,” said Russ Hardin, president of the foundation. “The foundation is pleased to partner with colleges and universities to help deserving young women achieve their educational goals.”

Lettie Pate Whitehead was married to Joseph B. Whitehead, one of the original bottlers of Coca-Cola. After Mr. Whitehead’s death in 1906, Mrs. Whitehead immediately assumed responsibility for her family’s business affairs, including the expansion of the Coca-Cola bottling business and the family’s real estate investments. She went on to become one of the first women to serve on the board of directors of a major American corporation, serving as the director of the Coca-Cola Company for almost 20 years. With a sense of deep compassion for those in need, she gave generously to a number of charitable causes in Georgia and Virginia during her lifetime.

Inspired by his mother’s example of caring for others, Conkey Pate Whitehead, Mrs. Whitehead’s younger son, created the foundation in honor of his mother. The Lettie Pate Whitehead Foundation first began making grants in 1954. In 2007, the foundation gave almost $ 23 million to the 215 institutions it supports. Parents have less disposable income for children’s play-related activities because of the economy and funding for Parks and Recreation departments nationwide continues to dwindle during a time when 82 percent of parents believe kids don’t spend enough time playing outside.^

Despite these challenges, 93 communities across the nation have taken innovative approaches to make play a priority to ensure their children have the time and space they need to play. To honor cities and towns making this commitment to play, KaBOOM!, a national non-profit dedicated to bringing play back into children’s lives, named them Playful City USA communities.

In the third year of this annual program, 32 of 93 Playful City USA communities were repeat honorees from 2008, while 22 cities were cited for the third consecutive year. Thirty-nine new communities have joined others in making a commitment to children, including Honolulu, Indianapolis and San Antonio. These 93 communities created and implemented programs to positively impact childhood wellness, public safety and the quality of life.

Each of the 2009 Playful City USA communities demonstrated creative commitments to the cause of play in the areas of quantity, quality and access. Quality relates to the number of usable, open playspaces. Quality involves subjective factors that encourage repeated use and make playspaces engaging, exciting, interesting and fun. Access entails the ability to get to a playspace (roads, trails) and a lack of barriers to the playspace (cost, safety, traffic, locked gates, equity).

Playful City USA celebrates and highlights these unique initiatives developed by communities across the country. A primary goal of Playful City USA is to encourage cities and towns to share creative ideas, concepts and programs in an effort to increase play opportunities for children. City initiatives include:

QUANTITY

    Dothan, Ala. (pop. 65,447)
After incorporating the KaBOOM! community build model for the construction of a playground, the City decided to use this method exclusively for any future playgrounds built in Dothan. The community build model offers a great opportunity to involve neighborhoods, while saving significant costs on construction.

    Indianapolis, Ind. (pop. 795,458)
The Indianapolis Parks and Recreation department is conducting a study that would involve converting abandoned housing and vacant lots and turning them into urban mini parks. This project will require that city department resources are combined to increase green spaces and remove abandoned housing, identify clusters of abandoned houses and vacant lots, identify potential mini park spaces, and host public meetings that would solicit the surrounding neighborhoods’ advice on the usage of these spaces.

Las Cruces Public Schools launched a free program called Recess Before Lunch in 2007 to examine what benefits could result. Molpus Timberlands Management, LLC (‘MTM’), is pleased to announce the commencement of a Forest Inventory Internship Program (‘Program’). The Program began in May 2009 and is being used to provide an invaluable 13-week, hands-on learning experience for undergraduate and recently graduated forestry students as well as provide MTM’s clients with productive inventory resources.

Interest in the 2009 Forest Inventory Internship Program was tremendous. Molpus Timberlands Management received numerous applications from interested students. Six students were chosen representing six separate forestry university programs in the Eastern United States including University of Illinois, Purdue University, West Virginia University, University of Tennessee, Auburn University and Jones County Junior College.

The 2009 Program is based out of Middlesboro, Kentucky and will provide inventory resources for Molpus’ clients in Eastern Kentucky and Eastern Tennessee.

The Program will provide MTM the opportunity to interact with a diverse pool of forestry students and future professional foresters. Clients of Molpus will gain valuable quality-based inventory resources that aid in forest management, planning and decision-making. Interns will gain valuable insight, skills and experience that will help guide their forestry careers.

This Program was initiated by Molpus Timberlands Management Inventory Management and Planning Department and helps MTM continue to develop advanced biometric solutions that improve growth and yield modeling and forest planning.
