States Challenge Attempted Federal Power Grab in Hydraulic Fracturing Issue

The Interstate Oil and Gas Compact Commission (IOGCC) reaffirmed its strong stance today that the states remain the best positioned to regulate the use of hydraulic fracturing for the production of oil and natural gas.

The response comes on the heels of a bill introduced in the House and the Senate yesterday calling for the repeal of the exemption of hydraulic fracturing from the Safe Drinking Water Act (SDWA), which would ultimately give the federal government jurisdiction over the regulation of the technology.

“The states do a superb job of protecting human health and the environment through sound regulation,” said Carl Michael Smith, IOGCC executive director. “An unnecessary shift to federal regulation of hydraulic fracturing could greatly inhibit the production of much-needed oil and natural gas resources at a time when our nation’s energy security is critical.”

Hydraulic fracturing is a common half century old technology that plays a major role in the development of virtually all unconventional oil and natural gas resources. Recently some have made claims that the process can contaminate underground drinking water sources.

Historically the states have been the primary regulators of hydraulic fracturing. IOGCC member states each have comprehensive laws and regulations to provide for safe operations and to protect drinking water sources, and have trained personnel to effectively regulate oil and natural gas exploration and production.

Multiple studies have been conducted on this issue, including an extensive study by the U.S. EPA in 2004 and a survey of IOGCC member state regulators. To date there are no verified cases of contamination of underground drinking water as a result of the process.

“As the head regulator of oil and natural gas development in the state of North Dakota and an officer of the IOGCC representing all oil and natural gas producing state regulators, I can assure you that we have no higher priority than the protection of our states’ water resources,” said Lynn Helms, director of North Dakota’s Department of Mineral Resources in a House Energy and Mineral Resources Subcommittee hearing last week. “It is my firmly held view and that of the IOGCC that the subject of hydraulic fracturing is adequately regulated by the states and needs no further study.”

The IOGCC passed a resolution urging Congress to refrain from taking action on this issue in December of last year maintaining that SDWA was never intended to grant the federal government authority to regulate oil and gas drilling and production operations, such as “hydraulic fracturing,” under the Underground Injection Control program. Since that time several states have followed suit and filed their own resolutions, including Alabama, Louisiana, North Dakota, Oklahoma, Texas, Utah and Wyoming.

“Regulation of hydraulic fracturing as underground injection under the SDWA would impose significant administrative costs on the state, substantially increase the cost of drilling oil and natural gas wells with no resulting environmental benefits, and increase energy costs to the consumer,” the resolution stated.

Contentious Federal Judicial Nominations, State Court Elections Focus of Next ABA President

Citing a nomination and confirmation process for federal judges that “too often involves lengthy, partisan conflict and delay,” incoming American Bar Association President H. Thomas Wells Jr. strongly backed prospective association policy that offers new ways to address the problem.

The proposed ABA policy emphasizes four approaches to creating a faster, less conflict-ridden method of appointment, beginning with a call for senators to establish bipartisan commissions in their states to evaluate the qualifications of prospective nominees to the U.S. District Courts. It also suggests similar commissions for the U.S. Courts of Appeals.

The commissions would recommend possible nominees whom the senators could suggest for the President’s consideration, recognizing that any nominating decision ultimately belongs to the President.

“This flexible approach does not outline particular steps or procedures to follow,” said Wells during a Monday news conference. “That’s best accomplished by the senators themselves.”

The policy also suggests that the administration use a consultative process involving home state senators of both parties and Senate leadership before deciding on nominees. As Wells explained, “This will help avoid battles whose costs outweigh their benefits to the President, the Senate, the nominees and the courts on which they may serve.”

The ABA is also emphasizing appropriate ways to shorten what has been a lengthy process, and ensure courts operate at full strength.

Wells noted that the ABA was pressing the measures now, before a new Congress and executive branch take office, so that the measures could be fully and fairly considered by all candidates.

“All of our leaders want our court system to remain the envy of the world and be filled with the best and brightest legal minds our country has to offer,” said Wells. “We hope to bridge the partisan divide that has grown over many years and offer government a way forward.”

Sandra Day O’Connor to Assist Wells with State Court Effort

Wells is also turning his attention to the problems of state courts and will organize a Fair and Impartial State Courts summit in May 2009 in Charlotte, NC that will devise new approaches to reducing the effects of what he termed “big money and fiery rhetoric” in state judicial campaigns, as well as exploring other threats to fair and impartial state courts. The summit will involve leaders from a variety of disciplines including the legal profession.

Wells noted that a state supreme court race during the last election cycle in his own state of Alabama cost more than $ 7 million.

“Frankly, that’s an obscene amount of money, and Alabama is not alone. In too many states judicial elections have become dysfunctional, distasteful affairs.”

Retired Supreme Court Associate Justice Sandra Day O’Connor has agreed to chair the summit.

Voting Rights and Responsibilities Also a Priority

Wells also noted that he takes office with less than 90 days until the national elections, and unveiled an ABA-developed Web site designed to inform the public and lawyers about voter rights and responsibilities. The site address is http://www.abavoteinfo.org.

“I urge lawyers nationwide to think about how they can make a difference in their community in this upcoming election,” Wells said.

FHLBank Atlanta will award the funds as part of its 2009 Affordable Housing Program (AHP) offering. The Chinese Drywall Complaint Center is demanding the United States Department of Justice get involved in the US toxic Chinese drywall disaster. The group says, “major building suppliers knew about toxic Chinese drywall as far back as 2005, and did nothing to alert US consumers in Florida. Major US homebuilders colluded to conceal toxic Chinese drywall from US homeowners in Florida as far back as 2005. Federal Home Loan Bank of Atlanta to Award $ 925,000 for Affordable Housing in Maryland












Atlanta (Vocus) February 19, 2010

Federal Home Loan Bank of Atlanta (FHLBank Atlanta) announced today that it will award $ 925,000 to help developers fund three affordable housing developments in Maryland. The funding is part of $ 40 million FHLBank Atlanta will award in 10 states to create or preserve 3,897 units of affordable housing.

FHLBank Atlanta will award the funds as part of its 2009 Affordable Housing Program (AHP) offering. Local community developers, in partnership with FHLBank Atlanta member institutions, will use the awards to build or repair 116 affordable housing units in the cities of Annapolis, Baltimore, and Oakland.

“For the past 20 years, FHLBank Atlanta has been providing economic stimulus to the communities we serve by helping to create affordable housing options and employment opportunities,” said Arthur Fleming, senior vice president and director of Community Investment Services, FHLBank Atlanta.

AHP is a competitive funding program that helps develop owner-occupied and rental housing for very low-, low-, and moderate-income families. FHLBank Atlanta awards the funds annually to member financial institutions and their community housing partners. Federal Home Loan Bank of Atlanta (FHLBank Atlanta) announced today that it has appointed a new member to its Affordable Housing Advisory Council. Priscilla Howard of Tallahassee, Fla. was selected to serve as one of the two council members from Florida. FHLBank Atlanta’s Affordable Housing Advisory Council has a total of 15 members. Howard’s term began May 1, 2010.

Howard currently serves as president of Community Solutions Group in Tallahassee. The Community Services Group specializes in assisting clients in all areas of affordable housing, including finance, and related local, state, and federal policy issues and capacity building. She also is the financial advisor for the Jacksonville Housing Finance Authority and community representative for the City of Tallahassee Affordable Housing Advisory Board. Howard has 24 years of experience in housing and community development. Previously, she was senior manager of the Florida Housing Finance Corporation’s affordable housing programs.
